How is Child Support Determined?
In Florida, child support is calculated by considering each parent’s ability to contribute to the financial support of their children and the children’s need for support. Usually a statutory formula computes the appropriate child support. While the net income of the parents is most often the focal point, the court can also consider other factors including:

  • The timesharing being exercised by the father and the mother
  • The assets of the father or the mother
  • Special needs of the child
  • Extraordinary medical, psychological and educational expenses
  • Independent income of the child.
  • The obligation to support other dependents (other children or dependent parents)
  • Seasonal fluctuations in income

Can Child Support by Modified?
Child support can be modified if there has been a substantial change in circumstances and a modification is in the best interest of the child. If you have experienced a reduction in your income, or the other parent’s income has increased, or if there has been a change in the time sharing being exercised, you should not delay in seeking a modification. In most cases, the court will only modify child support as of the date a petition for modification is filed.
